The National Association of Realtors’ Clear Cooperation Policy (CCP) is under scrutiny, raising concerns about how homes are marketed and sold. This policy, implemented in 2020, requires that any publicly advertised listing be entered into the Multiple Listing Service (MLS) within one business day. Its goal? To ensure broad market exposure, prevent "pocket listings," and create a fair and transparent system for buyers and sellers.
Why does this matter to home sellers?
Homes listed on the MLS typically sell for more due to greater visibility and increased competition among buyers. A recent Zillow study found that homes sold off-market fetched significantly lower prices—up to $30,000 less in California alone. Removing CCP could limit seller exposure, benefiting only a select group of agents and brokerages at the seller’s expense.
Why does this matter to home buyers?
Without Clear Cooperation, access to available homes could shrink, favoring buyers connected to specific brokerages and restricting fair competition. This could lead to increased exclusivity, discrimination, and reduced market transparency.

Without an MLS-backed system, market data will become less reliable, affecting home pricing, appraisals, and financing. Independent brokerages are already strategizing alternative solutions to maintain fairness and cooperation if CCP is repealed.
